Community Carport Sale. 1/9. Residents only!!

Community Carport Sale

The January carport sale will be for RESIDENTS ONLY
Saturday, January 9, 2021
10:00 am-3:00 pm

Per management, our carport sale will be for residents only. We understand this is disappointing to many of us, however, we must do what management asks us to do for our safety or we don’t have any events, it’s that simple. We can do this, but for it to be a successful event, we must do it together.
So, get busy and clean your shed, your closets, your kitchen cabinets, and Christmas decorations no longer needed for this sale. Get the location of your sale on our list that will be handed out at the start of the day. There are two ways to make certain your location is on the list. A sign-up sheet located in the clubhouse on the downstairs bulletin board or you may send an email to Carol Buie @ carolbuie69@yahoo.com. You don’t want your sale to be overlooked! Sign up or email no later than January 5, 2021 to make certain you get included on the list.
Please remember to wear your mask, social distance and sanitize your hands whenever possible. This is a free event to residents and sponsored by your Activities Committee.

LAWSUIT INFORMATION

The HOA Board is aware that there are many questions about the statement from management this morning concerning the lawsuit.  We have consulted with our attorney in order to provide you with accurate information. Here is a statement from our attorney concerning any potential effect on individual homeowners:  On advice of our lawyer, the Board has determined to file an appeal of the adverse ruling by the federal court. It was not unexpected that the defendants filed a request for their attorney’s fees to be awarded against the incorporated HOA. There is no guarantee that the judge will award them those fees. In light of the appeal, it is possible that the determination of what fees should be awarded may be postponed pending the appeal. If awarded prior to the conclusion of the appeal, enforcement of payment of those fees by the incorporated HOA would likely also be delayed. Regardless, since the class of homeowners was never certified, it is very unlikely that any homeowner will be exposed to any kind of attorney’s fee liability. Each of you would have a significant due process challenge to such an award against the individual homeowner.
We know there are other questions. Please bring them to the HOA membership meeting on September 14th. We will be working until then to gather more information so accurate answers can be given. Please understand that individual board members, not being attorneys, are advised not to give legal opinions on these matters.  In the meantime, you may call the attorney directly.
